Peer Consultation Liability Clause

  1. Nature of the Group
    This peer consultation group provides collegial discussion, professional support, and shared perspectives among licensed or pre-licensed mental health professionals. The group does not constitute formal clinical supervision, professional consultation, or legal advice.
  2. Independent Clinical Responsibility
    Each participant remains solely responsible for all clinical decisions, treatment planning, client care, and adherence to professional, ethical, and legal obligations. No participant, facilitator, or host organization bears responsibility or liability for the clinical work, actions, or omissions of any other participant.
  3. Non-Directive, Peer-Based Input
    Feedback, questions, or suggestions offered during meetings are understood to be peer opinions only. Participants agree that they will not rely on such feedback as authoritative direction or as a substitute for formal supervision, professional consultation, or legal counsel.
  4. Confidentiality of Case Information
    All participants agree to maintain professional confidentiality standards and to fully de-identify client information shared in the group. Each member is individually responsible for ensuring their disclosures comply with laws and ethical codes governing client privacy.
  5. Waiver of Liability
    By participating in the group, each member voluntarily releases, indemnifies, and holds harmless all other participants, facilitators, and any sponsoring organizations from any claims, liabilities, or damages arising from:
  • comments, suggestions, or information shared during consultation;
  • reliance on any peer feedback; or
  • decisions made in their own clinical or professional practice.
  1. Obligation to Seek Appropriate Guidance
    Participants acknowledge that complex clinical, ethical, or legal issues require consultation with qualified supervisors, experts, or attorneys. The peer consultation group is not a replacement for such services.
